  21. BBS and diskette (but not CD-ROM) mail order distributors are granted
  22. automatic permission to distribute the shareware version of Nitemare-3D.
  23. Most other classes of distributor, especially those involved with CD-ROM
  24. and retail distribution of shareware MUST obtain written permission first.

  26. Nitemare-3D is protected by U.S. Copyright laws and international treaty.
  27. Distribution of Nitemare-3D (both shareware and registered) is strictly
  28. controlled and any breaches of copyright will be vigorously enforced.

  32. DISTRIBUTION LICENSE

  35. As the exclusive copyright holder for this software David P. Gray authorizes
  36. distribution of the shareware version of this product only in accordance with
  37. all of the following restrictions:

  39. 1.  DOCUMENTATION.  This software package and all related program files
  40.     and documentation files, including VENDOR.DOC, LICENSE.TXT and ORDER.TXT
  41.     may NOT be modified in any way and must be distributed as a complete
  42.     package.  Vendors may add their own batch/documentation/program files for
  43.     the purpose of user installation.

  45. 2.  PRICE.  No price or other compensation may be charged for this software
  46.     package.  A distribution fee may be charged for the cost of the packaging,
  47.     shipping and handling as long as the total does not exceed US$6.00 in the
  48.     U.S. and Canada, or US$10.00 internationally.

  50. 3.  BUNDLING.  This software package may not be sold as part of any commercial
  51.     software or hardware packaging offer, without written permission from
  52.     David P. Gray.  We invite any manufacturer wishing to bundle this software
  53.     with their own products to contact David P. Gray.

  55. 4.  ENTICEMENT.  This software is not to be used as an enticement to purchase
  56.     another product without written permission from David P. Gray.

  58. 5.  TRANSLATION.  This software package including all documentation may not
  59.     be translated in any form whatsoever without written permission from
  60.     David P. Gray.

  62. 6.  PERMISSION.  Certain types of distribution require written permission as
  63.     detailed below.  Unlawful distribution without the required permission
  64.     constitutes a breach of copyright and will be vigorously enforced.

  81.     Nonprofit organizations and other non-commercial distributors such as
  82.         Computer clubs and Special Interest Groups are granted automatic
  83.         permission and do not need to contact David P. Gray.

  85.     Flea market, shoe box and swap meeting type vendors are granted
  86.     automatic permission and do not need to contact David P. Gray.

  90. END-USER LICENSE

  93. This is the first of three episodes.  Episode ONE is shareware.  The other
  94. TWO episodes are not.  The final two episodes must be purchased directly
  95. from David P. Gray.  Do not copy or distribute the registered versions.
  96.  
  97. 1.  Grant of License.  David P. Gray hereby grants you the right to
  98.     evaluate Nitemare-3D, Episode One, which is the shareware version
  99.     of this program, for a period of 30 days.  After this period you are
  100.     required to either cease using the program or purchase the program.
  101.     See the online Help in the game for details of how to purchase it.

  103. 2.  Licensee shall not use, copy, rent, lease, sell, modify, decompile,
  104.     disassemble, otherwise reverse engineer, or transfer the licensed program
  105.     except as provided in this license.  Any such unauthorized use shall
  106.     result in immediate and automatic termination of this license.

  108. 3.  Individuals are allowed to pass on copies of the shareware version of
  109.     this program to other individuals and to upload to BBSs.

  113. THIRD PARTY EPISODES

  116. The sale and distribution of third party episodes which work with this
  117. shareware version is prohibited and violates the copyright of this game.
  118. Distribution of such episodes would be in direct competition with our own.

  120. Anyone wishing to produce or distribute third party episodes for the
  121. registered version of the game may do so provided the following points
  122. are made clear to customers:

  124. 1.  The registered version of the game is required.
  125. 2.  The episodes are not connected with David P. Gray.
  126. 3.  No technical support is provided by David P. Gray.

  128. Please note that no technical assistance or toolkit is available from
  129. David P. Gray for third party episode development.

  133. DISCLAIMER OF WARRANTY

  137. kind, expressed or implied, including without limitation, any warranties of
